Payment is due upon order placement unless otherwise approved for credit terms. Credit terms are available by submitting a credit application for approval. To request a credit application, please email us at info@dalentmedical.com. If approved for credit, standard billing terms are net thirty (30) days. All major credit cards are accepted.
Pricing does not include any applicable Federal, State, Local, or other taxes. All applicable taxes will be added to the invoice unless a tax exemption certificate is provided.
Standard shipping; FOB Shipping Point, shipping costs pre-paid and added to invoice. All orders are shipped standard ground using FEDEX, UPS or USPS. Expedited shipping is available upon request for an additional charge. Dalent shall not be liable for goods damaged in transit, delivery delays, or lost packages once in the possession of the shipping carrier. Claims for goods damaged in transit, delays, or losses are to be made with the delivery carrier. Appropriate tracking number will be provided. Please do not accept damaged items unless noted on the Bill of Lading at the time of delivery. Dalent Medical shall not be liable for any failure or loss of delivery due to acts of god, labor strikes, war, civil commotion, pandemics or other public health crisis, fire, inability to obtain materials, destruction of plants, government acts, regulations, or any other cause beyond our control.
Dalent Medical expressly disclaims all warranties, whether written or oral, statutory, express or implied, by operation of law or otherwise, including, but not limited to, any implied warranties or merchantability, fitness or design, to the extent allowed by applicable law. Dalent Medical shall not be liable for any direct, incidental or consequential loss or damages, directly or indirectly arising from the use of this product. No representation or warranty of any kind, including but not limited to the statements regarding suitability for use, or performance of the product shall be or be deemed to be a warranty by Dalent Medical for any purpose. Dalent Medical neither assumes nor authorizes any other or additional liability or responsibility in connection with this device.
Customer acknowledges and understands that Dalent Medical has reserved the right to change the design of any of the products, to modify them or to discontinue the manufacture thereof at any time. US Customers Merchandise returned must have all manufacturer’s seals intact and be returned within 30 days from the date of invoice to be eligible for credit or replacement. Please contact the Dalent Medical Customer Service Department for details and Return Merchandise Authorization Number (RMA#) and shipping instructions. Returns will not be accepted without an RMA#, returned products past 30 days from invoice may be subject to a 15% restocking charge.
These Terms and Conditions may not be altered, supplemented, or amended by the use of any other document(s) unless otherwise agreed to in a written document signed by both Customer and Dalent Medical. For the avoidance of doubt, in the event of a conflict between these Terms and Conditions and any purchase order, these Terms and Conditions shall control. Governing Law. These Terms and Conditions and any sales hereunder shall be governed and construed in accordance with the laws of the State of Florida.
The failure of Dalent Medical to enforce strict performance of any provision of these Terms and Conditions or exercise any right hereunder shall not be construed as a waiver by Dalent Medical of any rights hereunder. In the event that any provision of these Terms and Conditions are held invalid by a court with jurisdiction over the parties, such provision shall be deemed to be restated to reflect as nearly as possible the original intentions of the parties in accordance with applicable law, and the remainder of these Terms and Conditions shall remain in full force and effect.
